Attorneys defective motor vehicle noted the exploding gas tanks dangerous. One such story of a woman in his 1985 Mercury Grand Marquis comes to mind. The woman was waiting to turn left turn on U.S. Highway 129 in Georgia, when a truck struck his car. It was hit again when his car was forced to traffic in the opposite direction. Bolts of a trailer hitch dug in the gas tank of his vehicle, causing it to catch fire. The doors and the passenger seat stuck Gibson collapsed, leaving dropped her back into the flames. She burned to death at the scene.
Widowed Gibson, Artumus Gibson, filed a lawsuit against Ford and the manufacturer trailer hitch, Draw-Tite. Gibson produced prosecutor RC car noted that up to 50 other people were killed or seriously burned in Accidents involving defective products like Ford. He added that Ford exploding gas tanks to continue on the road, and that Ford had "never warned a soul. "
In 1970 the National Highway Traffic Safety Administration (NHTSA), the researchers concluded that the available technologies, such as the location of safe tanks, valves, lines of steel fuel bladders and existed to protect occupants who survived to 65 mph rear impact of fire deaths. The fact remains that Ford has a long history of denying the security defects, not only in the face of a security breach, but also documented security flaw was obvious that Ford then had to recall cars in a storm of protest public.
Ford has refused to disclose information about other lawsuits product liability cases filed in similar explosion gas tanks. He chose to release only a brief statement on the Gibson case. The judge ruled that if Ford does not provide the files, then the jury should consider as an admission that the seats and fuel tank were defectively designed.
The Athens-Clarke County jury returned a verdict of $ 13 million to a widower.
A spokesman for Ford complained that Ford had not had a fair trial in this case. In its appeal, Ford challenged a decision of the State Court to punish the manufacturer for refusing to hand over records about crash tests car, he had conducted on this model. Ford argued the documents should remain confidential as attorney-client communications.
The Supreme Court of Georgia confirmed the Athens-Clarke County jury verdict. She said that the evidence sought car dealership had passed the crash tests of cars driven by Ford vehicle that included the Mercury Marquis. And that these cars had the same parts of the fuel tank and performance as the Marquis Mercury led by Mrs. Gibson, at the time of the incident on faulty fuel tank. This evidence could demonstrate knowledge of Ford before direct fuel system, a door and rear seat design problems in car-to-car collisions like the one that caused the death of Mrs. Gibson.
This is an important decision because it was based on the fact that Ford has refused to challenge the accident data car where it was required by law to provide to plaintiffs. The Georgia Supreme Court is essentially saying that they hold large companies, including carmakers, to the letter of the law.
Artumus Gibson, devastated by grief over the tragic death of his wife, summoned the courage to confront a giant manufacturer. Holding Ford responsible for a defective car unnecessarily is an act highly commendable, probably alerted others to this danger potential. Our hope is that these lawsuits, and lawsuits that we filed against Ford and other automakers will convince design safer vehicles more resistant to shocks and prevent others from being seriously injured or killed.
I wish to extend our most sincere condolences to Artumus Gibson for his devastating and irreplaceable loss.
